Binh Dinh province: Dissemination of Decree 42 on administrative sanctions in the fisheries sector (19-08-2019)

In the morning of August 2, the Department of Agriculture and Rural Development organized a conference to disseminate and disseminate Decree 42/2019 / ND-CP (Decree 42) of the Government stipulating penalties for administrative violations in the field of fisheries for more than 40 delegates and representatives of relevant departments and agencies; leaders of People's Committees, Divisions of Economic, Divisions of Justice of coastal districts and cities in the province.

Decree 42 of the Government took effect from July 5, 2019, including 4 chapters, 58 articles of new provisions on sanctioned subjects, sanctioning competence in the field of aquaculture and fisheries exploitation in accordance with the 2017 Fisheries Law with a fine of up to VND 1 billion for individuals and VND 2 billion for organizations. In particular, the case of fishing ship owners with a length of between 15 m and 24 m or more will be fined from VND 300 to 700 million, when exploiting aquatic resources in Vietnamese waters without fishing permits, having no cruise monitoring equipment or having equipment that does not maintain operation, or fishing activities without recording fishing diary. For acts of fishing vessels violating foreign waters, the ship owners will be fined from VND 800 million up to 1 billion.

Mr. Phan Trong Ho, Director of Department of Agriculture and Rural Development, said: “Decree 42 has completed the legal framework system for sanctioning violations in the field of fisheries that have not previously been specified. The Department has issued a plan to propagate Decree 42 and asked the local authorities to coordinate the implementation of widespread dissemination to local people to grasp implementation”.
