Captains of fishing vessels must submit fishing logbooks to managing fishing port organizations before the time of loading and unloading aquatic products through ports (25-12-2020)

Recently, the Ministry of Agriculture and Rural Development has issued Circular No. 13 / 2020 / TT-BNNPTNT dated 9/11/2020 (Circular 13) amending and supplementing a number of articles of Circular No. 21/2018 / TT-BNNPTNT dated November 15, 2018 (Circular 21) on the regulations on recording and submitting reports and fishing logbooks; publish a designated fishing ports to certify the origin of aquatic products from fishing; lists of illegal fishing vessels; certification of raw materials and certification of the origin of the fishing aquatic products.

In the course of implementation of Circular 21, there have been problems and shortcomings related to regulations on recording, submitting reports and fishing logbooks; announcing fishing ports to certify the origin of fishery products from fishing; list of illegal fishing vessels ; certification of raw materials and and certification of the origin of the fishing products that fishermen, enterprises and management agencies encounter. Therefore, Circular 13 has amended the inappropriate and inadequate points in Circular 21 and takes effect from December 25th.

Accordingly, Circular 13 has amended some contents in Article 4, Article 5, Article 7, Article 8, Article 15, Article 17, and Article 19 of Circular 21.

Specifically, Clause 1, Article 4 is amended as follows: The captains of the fishing vessel with the largest length of 12 meters or more must record the daily fishing logbookss according to Form No. 01, Annex I issued together with this Circular; submit the fishing logbooks to the managing fishing port organizations before the time of loading and unloading aquatic products through the port.

Clause 1, Article 5 is amended as follows: The captains of the vessels purchasing and conveying fishery products must record the daily logbooks of purchase and transfer of fishery products according to Form No. 02, Annex I issued together with this Circular; submit the logbookss of purchase and transfer of fishery products to the managing fishing port organization before the time of loading and unloading aquatic products through the port.

In Clause 2.3 (Article 7) on supervision of the loading and unloading through the ports has been amended: When receiving the port proposal of the fishing vessel captains, the managing fishing port organizations, according to the list of illegal fishing vessels, will recognise the fishing vessels that are on the list of illegal fishing vessels and not allow the loading and unloading of fishery products; notify the authorities to handle according to regulations.

In case they are not on the list of illegal fishing vessels, the managing organizations may arrange the fishing vessels to dock at ports for loading and unloading fishery products; appoint officials to supervise the output and composition of aquatic species loaded and unloaded through the ports.

In case 20% increase of actual loading and unloading fishery products output compared to the output declared before docking is detected, the managing organizations will take the minutes and handle this situation according to their competence or hand over to competent agencies for handling according to regulations.

Regarding the receipts of fishery products loaded and unloaded through ports (in Clause 3, Article 7 of the Circular 21), regulations are also amended: At the request of aquatic purchasing organizations and individuals fishing port managing organizations check the information declared on the receipts of fishery products loading and unloading through the port according to "Form No. 02 Appendix II" issued together with the Circular, confirm whether the information is true to the actual fishing vessels docked at the ports or not; save a copy taken at the fishing port managing organizations.

Organizations and individuals purchasing fishery products from each fishing vessel docked at the port are granted 01 receipt of fishery products loading and unloading through the port in accordance with the volume and composition of the purchased species.

In addition, Circular 13 has amended some contents in other terms of Circular 21.

According to the terms of transition, the captains of the vessels purchasing and transporting fishery products have recorded the Purchase and Transmission Logbooks in the form in Circular No. 21 before the effective date of Circular 13, which is used to carry out the confirmation of fishery products for such sea trips.

A receipt of loading and unloading of fishery products through the ports issued before the effective date of Circular 13 may continue to be used until the expiration of the time limit stated on the granted receipt.

Circular 13 takes effect from December 25, 2020.
