Implementing the 2017 Fisheries Law and guiding documents (23-05-2019)

Implementing the Fisheries Law in 2017, the Government issued Decree No. 26/2019 / ND-CP dated March 8, 2019 while The Ministry of Agriculture and Rural Development issued guiding circulars for implementing 2017 Fisheries Law. In which there are many new contents compared to the 2003 Fisheries Law such as regulations on the management of fishing vessels, fishery logistic facilities, combating illegal, unreported and unregulated (IUU) fishing, co-managed in the protection of fisheries resources, aquaculture, aquaculture logistics facilities, etc.
Implementing the 2017 Fisheries Law and guiding documents

To implement synchronously and effectively the contents related to the 2017 Fisheries Law and guiding documents, on May 15, 2019, the Quang Binh Provincial People's Committee issued Official Letter No. 651 / UBND-KT on implementing the 2017 Fisheries Law and guiding documents. Accordingly, the Provincial People's Committee required relevant departments and agencies, districts, cities and towns to base on the assigned functions and tasks to organize the implementation of the contents specified in the 2017 Fisheries Law, guiding documents and Plan No. 832 / KH-UBND dated May 31, 2018 of the province.

For People's Committees of districts, cities and towns, it is necessary to strengthen training, propaganda, dissemination and guidance of contents stipulated in the 2017 Fisheries Law and guiding documents for professional officers at district and commune levels, organizations and individuals involved in fisheries activities in the locality so that those are well aware of the implementation, ensuring the rights and obligations of organizations and individuals; and at the same time direct professional units and commune-level People's Committees to organize the performance of state management and direction tasks under their assigned competence in the 2017 Fisheries Law and guiding documents such as: Recognizing and assigning management rights in protecting aquatic resources in areas under management of community organizations; to announce the opening and closure of 3rd class fishing ports to fishing port management organizations under their management; organizing the management of fishing vessels with the largest length of less than 6m; review and statistics on the number of fishing vessels with a capacity of under 20CV decentralized management in Decision No. 29/2013 / QD-UBND in groups of the largest length of under 6m, from 6m to under 12m, from 12m to under 15m and over 15m to coordinate with other departments in managing fishing vessels according to regulations.

The Provincial People's Committee requested the Department of Agriculture and Rural Development to coordinate with the local to propagate and guide the basic contents of the 2017 Fisheries Law and guiding documents; appointing reporters to participate in propaganda activities if local authorities require; solving difficulties and obstacles under the authority during the implementation process; at the same time, presiding over and coordinating with departments, branches, districts, towns and cities to review legal documents issued by the province with contents that are not consistent with the 2017 Fisheries Law to advise documents amend, supplement, replace, abolish or issue new legal documents to ensure compliance with regulations. The province also organize the investigation and assessment of aquatic resources reserves in coastal areas of the province; announcing the opening and closing of 2nd class fishing ports for fishing port management organizations; recognizing and assigning management rights in protecting aquatic resources to community organizations in areas from two or more districts.

In addition, the Provincial People's Committee also requested the Provincial Border Guard Command to strengthen the strict control of fishing vessels when departuring and entering the ports; organizing patrols, inspections and control on Quang Binh sea area; Do not allow vessels to depart when there are not enough papers and equipment according to the provisions of the 2017 Fisheries Law and the guiding documents. Department of Information - Communication directs and orients media agencies to strengthen propaganda and dissemination of regulations of the 2017 Fisheries Law and guiding documents.
